1. Agreement to Terms

By accessing or using the SuppSaver website located at thesuppsaver.com.au (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must cease using the Service immediately.

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

2. Description of Service

SuppSaver operates as an independent price comparison and search engine for supplement products sold by third-party Australian retailers. The Service aggregates publicly available pricing, product, and nutritional information from these retailers and presents it in a standardised format to assist consumers in making informed purchasing decisions.

SuppSaver does not sell, distribute, manufacture, or fulfil orders for any supplement products. All purchases are made directly through the respective third-party retailer's website, and all transactions are subject to that retailer's own terms and conditions.

The prices, availability, stock levels, and product information displayed on SuppSaver are aggregated from third-party sources and may not reflect real-time accuracy. While we endeavour to keep information current through regular automated updates, we do not guarantee the completeness, accuracy, or timeliness of any data displayed on the Service.

3. Intellectual Property and Copyright

All original content on the Service — including but not limited to the website design, user interface, layout, source code, compiled price comparison data, normalised nutritional datasets, written guides, analytical commentary, and graphical elements — is the intellectual property of SuppSaver and is protected by Australian copyright law under the Copyright Act 1968 (Cth) and applicable international treaties.

The compiled database of standardised supplement pricing, nutritional information, and historical price data constitutes a protected compilation under Australian law. The selection, coordination, arrangement, and normalisation of this data involved substantial intellectual effort and investment, and the resulting compilation is the exclusive property of SuppSaver.

Product names, brand names, logos, and images displayed on the Service remain the property of their respective owners and are used solely for the purpose of identification and comparison. Their presence on the Service does not imply any endorsement, sponsorship, or affiliation.

4. Prohibited Use

You agree not to use the Service in any manner that:

• Involves the automated collection, scraping, crawling, harvesting, or extraction of data from the Service, whether by bot, spider, scraper, or any other automated means, without prior written consent from SuppSaver.
• Involves the bulk downloading, copying, reproducing, or systematic retrieval of price comparison data, nutritional datasets, or any other content from the Service for commercial or competitive purposes.
• Involves the republication, redistribution, licensing, sale, or commercial exploitation of any data or content obtained from the Service without prior written consent.
• Interferes with, disrupts, or places an unreasonable burden on the Service's infrastructure, servers, or networks.
• Attempts to reverse engineer, decompile, disassemble, or otherwise derive the source code, algorithms, or data processing methods used by the Service.
• Circumvents, disables, or otherwise interferes with any security, access control, or rate-limiting features of the Service.
• Violates any applicable local, state, national, or international law or regulation.

SuppSaver reserves the right to restrict or terminate access to the Service for any user or entity found to be in violation of these prohibitions, without prior notice.

5. Nutritional and Health Information Disclaimer

The nutritional information displayed on the Service is aggregated from third-party retailer websites and product labels using a combination of automated scraping, optical character recognition (OCR), and artificial intelligence technologies. While we employ multiple validation and cross-referencing methods to ensure accuracy, this data is provided for informational and comparison purposes only.

The nutritional data on SuppSaver does not constitute medical, dietary, or health advice. You should not rely solely on the nutritional information presented on the Service when making dietary or health decisions. Always consult the product label directly and seek advice from a qualified healthcare professional before commencing any supplement regimen, particularly if you have pre-existing medical conditions, allergies, or are taking medication.

SuppSaver makes no representations or warranties regarding the suitability of any product for any particular purpose, health condition, or individual.

6. Outbound Links and Voluntary Donations

The Service contains outbound links to third-party retailer websites and, separately, to a third-party donation platform (Ko-fi) for users who wish to voluntarily support the Service. SuppSaver participates in the Amazon Associates Program and may earn a commission on qualifying purchases made through outbound Amazon links, at no additional cost to you; it does not display third-party advertising.

In accordance with Australian Consumer Law and applicable advertising standards:

• Our price comparison rankings and data are purely mathematical and are not influenced by any commercial arrangement, voluntary donation, or any other relationship with a retailer or user.
• If a retailer offers the lowest price, that price is displayed without preference or bias.
• Voluntary donations received via the donation platform do not affect the order, ranking, or visibility of any product or retailer.

When you click an outbound link (to a retailer or to the donation platform), we log anonymised click data (a hashed identifier, timestamp, and destination name) for analytics purposes. No personally identifiable information is stored as part of this process.

7. Third-Party Content and Links

The Service contains links to and data sourced from third-party retailer websites. SuppSaver does not control, endorse, or assume responsibility for the content, products, services, privacy policies, or practices of any third-party website.

You acknowledge and agree that SuppSaver shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods, or services available on or through any third-party website.

8. Limitation of Liability

To the maximum extent permitted by law, SuppSaver, its operators, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with:

• Your use of, or inability to use, the Service.
• Any reliance placed on pricing, nutritional, or product information provided by the Service.
• Any action taken or decision made by you based on information available on the Service.
• Any inaccuracies, errors, or omissions in the data displayed on the Service.
• Unauthorised access to or alteration of your data or transmissions.

Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies that you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable consumer protection legislation that cannot be excluded, restricted, or modified by agreement.

Where liability cannot be excluded under such legislation, SuppSaver's liability is limited, to the extent permitted by law, to the re-supply of the relevant service or the payment of the cost of having the relevant service re-supplied.

9. Indemnification

You agree to indemnify, defend, and hold harmless SuppSaver, its operators, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

10. Changes to Terms

SuppSaver reserves the right to modify or replace these Terms at any time at its sole discretion. Material changes will be indicated by updating the "Last updated" date at the top of this page.

Your continued use of the Service following the posting of any changes constitutes acceptance of those changes. It is your responsibility to review these Terms periodically for updates. If you do not agree to the revised Terms, you must discontinue use of the Service.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in the State of Victoria, Australia, for the resolution of any disputes arising out of or relating to these Terms or the Service.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms shall remain in full force and effect.

13. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SuppSaver regarding the use of the Service and supersede all prior agreements, representations, and understandings.
